Definitions
- Service Terms and Conditions - these regulations
- Service - the website of the "Museum of the Eastern Territories of the Former Commonwealth", operating at https://ziemiewschodnie.pl
- Museum - "Museum of the Eastern Territories of the Former Commonwealth" with the address of the registered office in Lublin at Plac Litewski 3, 20-400 Lublin, email: mzwdr@mnwl.pl
- Customer - any natural person accessing the Website and using the services provided through the Website by the Museum.
- Electronic Communication - Communication between the parties by electronic mail (e-mail).
General provisions
- The Terms and Conditions, sets out the rules for the operation and use of the Site and defines the scope of the rights and obligations of Service Recipients and the Museum in connection with the use of the Site.
- The object of the Museum's services is to provide free of charge tools in the form of the Website, enabling Service Recipients to access content in the form of posts, articles and audiovisual material or web applications and electronic forms
- Any possible content, articles and information containing tips or advice published on the Site is only a general collection of information and is not directed at individual Service Recipients. The Museum is not responsible for their use by Service Recipients.
- The recipient assumes full responsibility for the use of material made available on the Site, including its use in accordance with applicable law.
- The Museum does not give any warranty as to the suitability of the material on the Website.
- The Museum shall not be liable for any damages incurred by Service users or third parties in connection with the use of the Site. All risks associated with the use of the Site and, in particular, with the use and exploitation of the information posted on the Site, shall be borne by the Service Recipient using the Site.
Terms of use
- The use of the Site by each Service Recipient is free of charge and voluntary.
- Service recipients are required to read the Terms and Conditions and the other documents forming an integral part of the Terms and Conditions and must accept them in full in order to continue using the Site.
- Service recipients may not use any personal data obtained on the Website for marketing purposes.
- Technical requirements for using the Website:
- a device with a display capable of displaying web pages,
- internet connection,
- any web browser that displays web pages in accordance with the standards and provisions of the W3C Consortium and supports web pages made available in HTML5,
- javaScript enabled,
- cookies enabled
- In order to ensure the safety of the Museum, the Service Recipient and other Service Recipients using the Site, all Service Recipients using the Site should adhere to generally accepted network security principles,
- The following actions carried out personally by Service Recipients or by using software are prohibited:
- without written permission, decompilation and analysis of the source code,
- without written permission, causing an excessive load on the Service's server,
- without written consent, attempts to discover vulnerabilities in the Service's security and server configuration,
- attempts to upload or inject code, scripts, and software onto the server and into the database that may harm the Site's software, other Service Recipients, or the Museum,
- attempts to upload or inject code, scripts and software on the server and in the database that may trace or steal data from Service Recipients or the Museum,
- taking any action to damage, block the operation of the Service or prevent the Service from fulfilling its purpose.
- In the event of the discovery of the occurrence or potential occurrence of a Cyber Security incident or a breach of GDPR, Service Recipients should in the first instance report this to the Museum in order to quickly rectify the problem/threat and safeguard the interests of all Service Recipients.

- If a Client contacts the Service Provider, the Client's personal data is processed in accordance with the "Privacy Policy", which is an integral part of the Terms and Conditions.
Data about Service Recipients
In order for the Service to provide its services correctly, to safeguard the Museum's legal interest and to ensure that the Service operates in accordance with applicable law, the Museum collects and processes certain data about Users through the Service.
In order to properly provide its services, the Website uses and records certain anonymous information about the User in cookies.
The scope, purposes, manner and principles of data processing are available in the appendices to the Terms and Conditions: "GDPR Policy" and in the "Service Privacy Policy", which form an integral part of the Terms and Conditions.

- In addition, in order to properly provide the services provided by the Service, to safeguard the Museum's legal interest and to ensure that the Service operates in accordance with applicable law, the Museum collects and processes the following data about Users through the Service:

- user identifiers on social networks
- Telephone
- Age
- Address of residence
- In addition, in order to ensure the proper provision of services by the Service, to safeguard the Museum's legal interest and to ensure that the Service operates in accordance with applicable law, the collection of memorabilia is carried out in accordance with separate Terms and Conditions, which are attached to and form an integral part of these Terms and Conditions
Copyright
- The Museum is the owner of the Service and the copyright of the Service.
- Some of the data on the Website is protected by copyright belonging to companies, institutions and third parties, not connected in any way with the Museum, and is used under licences obtained or based on a free licence.
- Pursuant to the Act on Copyright of 4 February 1994, it is prohibited to use, copy, reproduce in any form or save in search systems, with the exception of Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook and LinkedIn, any articles, descriptions, photos and any other content, graphic, video or audio material on the Website without the written consent or approval of the legal owner of the same.
- In accordance with the Act of 4 February 1994 on copyright, simple press releases, understood as mere information without any commentary or evaluation by the author, are not protected. The author understands this to mean that they may use the information from the texts on the website, but no longer copy all or part of the articles, unless this is indicated in the individual material on the website.
Amendments to the Terms and Conditions
- All provisions of the Terms and Conditions may be unilaterally amended by the Museum at any time, without giving reasons.
- Amendments to the Terms and Conditions shall enter into force immediately after their publication.
- By continuing to use the Site after the Terms and Conditions have been amended, each User is deemed to have accepted them in full.
Final provisions
- The Museum makes every effort to ensure that the services of the Service are offered on a continuous basis. However, it does not accept any liability for disruptions caused by force majeure or unauthorised interference by Service Recipients, third parties or the operation of external automated programmes.
- The Museum reserves the right to change any information posted on the Website at any time selected by the Museum, without prior notice to Service Recipients using the Website.
- The Museum reserves the right to shut down the Website temporarily, in whole or in part, in order to improve it, add services or carry out maintenance, without prior notice to users.
- The Museum reserves the right to shut down the Service permanently, without prior notice to Service users.
- The Museum reserves the right to assign, in part or in whole, any of its rights and obligations in relation to the Site, without the consent of or the possibility of any objection by the Service Recipients.

Appendix 1: TERMS AND CONDITIONS OF COLLECTIONS
TERMS AND CONDITIONS OF COLLECTIONS
Article 1
- The organiser of the action "Z Kresów ocalone: zbiórek pamiątek i opowieści kresowych" (From the borderlands saved: a collection of borderland memorabilia and stories), hereinafter referred to as the Collection, is the National Museum in Lublin, based in Lublin, 20-117, ul. Zamkowa 9, an institution entered in the Register of Cultural Institutions kept by the Minister of Culture, National Heritage and Sport under number 122/2020, NIP: 9462700771, REGON 387167680, hereinafter referred to as the 'Museum'.
- The collection begins on 14 September 2020 and will continue until cancelled by the Museum Director.
- The collection is not subject to registration on the zbiorki.gov.pl portal.
- The Collection Coordinator, Krystyna Rzędzian, Chair of the Exhibition and Project Coordination Team, Department of Art and Visual Culture, is responsible for conducting the Collection.
Article 2
- The aim of the collection is to acquire and preserve memorabilia and oral histories, i.e. memories related to the Kresy - the Eastern Lands of the former Republic of Poland, hereinafter referred to as "Items".
- The collection will be carried out by accepting in-kind donations and/or oral history recordings provided by persons willing to donate the Items free of charge, hereinafter referred to as Donors.
- The collection will be carried out by Museum staff with an appropriate badge bearing the Museum logo.
Article 3
- Items will be accepted by staff at the Collection Point at Lubomirski Palace (3 Litewski Square, 20-080 Lublin) - the future seat of the Museum of the Eastern Territories of the Former Commonwealth of Poland, or at another location indicated by the Museum Director, as well as at temporary Collection Points - places announced on the Museum website.
- The Museum will announce on its own website the dates on which Museum employees are on duty at the Collection Point indicated in paragraph 1 to receive Items and the dates on which actions are carried out at temporary Collection Points.
- Those who are interested in donating the Items should call the number: +48 726 022 100 or send email to zbiorka@mnwl.pl to arrange a date for the handover of the object and/or oral history.
- Persons interested in donating Items should deliver them by the agreed deadline to the Collection Point indicated in paragraph 1 or the temporary Collection Points referred to in paragraph 1.
- In justified cases, an authorised Museum employee may collect the Items at a location agreed with the Donor, after the Donor has provided a description of the Items together with photographic documentation and agreed by telephone: +48 726 022 100, by post to the Museum's registered office address or by email zbiorka@mnwl.pl.
Article 4
- The handover of the Items must be confirmed on the day of handover with the relevant documents:
- in the event of the transfer of gifts in kind, an inventory shall be made:
- declaration of the Donor on the transfer of the gift, 3 copies (1 for the Donor, 2 for the Museum) - the specimen declaration is attached as Appendix No. 1;
- the Museum's declaration of acceptance of the gift, 3 copies (1 for the Donor, 2 for the Museum) - the specimen declaration is attached as Appendix No. 2;
- an acceptance report confirming the physical transfer of the donation, 2 copies (1 each for the Donor and the Museum) - a model report is attached as Appendix 3;
- in the case of a donation of an oral history, a consent is written for the recording and use by the Museum of the resulting recordings (3 copies, 1 for the Donor, 2 for the Museum) - a specimen consent is attached as Appendix 4.
- The Museum staff responsible for accepting the Items are required to collect from the Donor the data necessary to sign the documents mentioned in paragraph 1.
- Museum staff will take a photograph documenting the state of preservation of the Item at the time of its transfer to the Museum.
Article 5
- Items acquired will be included in the Museum's collection records, in the order of priority in line with general conditions. The historical and material value of the Items will be assessed at a meeting of the Commission for the Acquisition of Works of Art and Items of the National Museum in Lublin. Any entry into the inventory of Items acquired during the Collection will be subject to the decision of the aforementioned Commission.
- Employees participating in the Collection do not consider offers for sale. In justified cases, such offers may be presented to the Art and Item Acquisition Committee, which will consider them in accordance with the procedure provided for in the Terms and Conditions.
Article 6
- The Museum reserves the right to refuse to accept donated Items.
- The Museum reserves the right to cancel the collection without giving a reason.
- The Museum reserves the right to amend these Terms and Conditions at any time without giving reasons.

- I declare that I am the owner of the object of the donation and that I am entitled to the copyright in it. With the release of the object of the donation, I transfer to the Museum, free of charge, the entirety of the author's economic rights to the object of the donation, together with the right to exercise derivative rights in all fields of exploitation provided for in Article 50 of the Act of 3 February 1994 on Copyright and Related Rights.
- I declare that the object of the donation is not limited or encumbered by any third party rights.
- I declare that the release of the object of the donation takes place with the signing of this declaration.
Article 2 Consents
- I agree / I do not agree* that in the case of displaying or publishing the image of the objects forming the subject of the donation, the Museum will place information about the Donor according to the following scheme: name and surname of the Donor, place of origin of the object - place of residence of the Donor (e.g. Jan Kowalski, Lviv - Wroclaw).
- I give / do not give permission* for the Donor's name to be included in the general list of Donors to the Collection, which will be posted on the Collection website.

At the same time, I declare that I transfer, free of charge and without territorial restrictions, the author's economic and non-economic rights arising in connection with the above circumstances to and with the consent of the Museum in all fields of exploitation provided for in Article 50 of the Act of 3 February 1994 on Copyright and Related Rights, in particular:
- 1) with regard to recording and reproduction - production of copies by a specific technique, including printing, reprography, magnetic recording and digital technique, copying, recording and reproduction by all known techniques, including digital, electronic, all video techniques, printing techniques and also with regard to:
- reproduction, recording, use in publications, promotional materials and activities;
- reproduction, fixation, use on the Internet, television;
- reproduction, fixation, use in promotion;
- input into the computer's memory, storage in the computer's non-volatile memory, exploitation on any number of workstations (uploading, downloading);
- reproduction in the form of electronic recording in computer memory and in internal and external networks;
- reproduction, recording, use on the Internet, including making it public on the WWW in a way that allows free use and unlimited reproduction of the work by any user of the public network;
- digitalisation.
- 2) with regard to dissemination of works in a manner other than specified above - public performance, exhibition, display, reproduction and broadcasting and re-broadcasting, as well as making the work available to the public in such a way that everyone can have access to it at a place and time of their own choosing (including the Internet).
